1. Acceptance of Terms

By accessing petrichordigital.com or using any Services offered by Petrichor Digital (including booking a call via Calendly or streaming our educational video library hosted on Google Drive), you (“User” or “you“) agree to be bound by these Terms of Use (“Terms“). If you do not agree, please refrain from using the Site.

2. Who We Are

The Site is operated by SJM Digital Services Limited (trading as Petrichor Digital), a company registered in England and Wales (Company No. 12091795) with its registered office at Unit 29 Highcroft Industrial Estate, Enterprise Road, Waterlooville, England, PO8 0BT.

3. Changes to Terms

We may update these Terms at any time. Updated versions will be posted on this page with a new “Effective date.” Continued use after changes take effect constitutes acceptance.

4. Use of the Site & Services

  1. Eligibility – You must be at least 16 years old and have capacity to enter a contract.
  2. Permitted Use – The Site and content are provided for lawful, business‑to‑business purposes related to marketing services.
  3. Prohibited Conduct – You agree not to:
    • Violate any law or regulation;
    • Infringe intellectual‑property rights;
    • Upload malicious code or attempt to gain unauthorised access to systems;
    • Use the Site to transmit unsolicited advertising (spam);
    • Misrepresent your identity or affiliation.

5. Intellectual Property

All content, trademarks, graphics, logos, text, videos and code on the Site are owned by Petrichor Digital or its licensors and are protected by copyright and other laws. You may view, download and print content for your internal business reference only. You may not reproduce, distribute, modify or create derivative works without our prior written consent.

6. Third‑Party Services & Links

Our Site integrates Calendly for scheduling and links to Google Drive resources. These third‑party services are governed by their own terms and privacy policies, which we do not control. We are not responsible for their content, availability or practices.

7. Disclaimer of Warranties

The Site and Services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy and non‑infringement. We do not guarantee that the Site will be uninterrupted, error‑free or secure, or that using our educational resources will produce specific marketing results.

8. Limitation of Liability

To the fullest extent permitted by law, Petrichor Digital shall not be liable for any indirect, special, incidental or consequential damages, loss of profits, data, goodwill or business opportunity arising out of or in connection with the Site or Services, even if advised of the possibility. Our total aggregate liability for any claim shall not exceed £500 or the amount you have paid us for Services in the 12 months preceding the claim, whichever is greater.

9. Indemnity

You agree to indemnify and hold harmless Petrichor Digital, its directors, employees and agents from any claims, damages, liabilities and expenses (including legal fees) arising from your breach of these Terms or misuse of the Site.

10. Termination

We may suspend or terminate your access to the Site without notice if you violate these Terms. Clauses that by their nature should survive termination shall do so (e.g. intellectual property, disclaimers, limitation of liability).

11. Governing Law & Jurisdiction

These Terms and any dispute arising hereunder shall be governed by the laws of Scotland. The courts of Glasgow, Scotland shall have exclusive jurisdiction, except that we may seek injunctive relief in any jurisdiction.
